Dhubs.in - Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the services and website (collectively, the “Service”) provided by dhubs.in (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Dhubs.in provides freelance digital marketing services, which may include, but are not limited to:

  • Content Creation

  • Pay-Per-Click (PPC) Advertising Management

  • Website Design and Development (as specified in a separate contract)

Specific details, scope of work, fees, and payment schedules for any project will be outlined in a separate written Service Agreement or Contract which, once executed, will supersede these general Terms.

2. User Obligations

As a user of dhubs.in, you agree to the following:

  • You will not use the Service for any unlawful or prohibited purpose.

  • You will provide accurate, current, and complete information when engaging our services.

  • You are responsible for maintaining the confidentiality of any login information for your own platforms (e.g., website, social media accounts) that you share with us.

  • You warrant that you own or have the necessary licenses and permissions for any content, images, trademarks, or data you provide to us for use in the marketing campaign

3. Intellectual Property

A. Dhubs.in Property

The Service and its original content, features, and functionality (excluding content provided by you or third parties) are and will remain the exclusive property of dhubs.in and its licensors.

B. Client Property

Upon full and final payment for the services rendered, the intellectual property rights to the deliverables specifically created for you (e.g., ad copies, final design files) will be transferred to you, unless otherwise specified in the Service Agreement.

4. Fees and Payment

  • All fees are set out in the specific Service Agreement or Quote provided to you.

  • Payment terms, including upfront deposits, milestones, and final payment, will be strictly enforced as detailed in the Service Agreement.

  • We reserve the right to suspend or terminate services for any overdue invoices.

  • All prices listed are in Indian Rupees (INR) unless otherwise noted.

5. Termination

We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

6. Limitation of Liability

In no event shall dhubs.in, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;

  • Any conduct or content of any third party on the Service;

  • Any content obtained from the Service; and

  • Unauthorized access, use, or alteration of your transmissions or content.

7. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or related to the Service shall be subject to the exclusive jurisdiction of the courts located in Calicut City (Kozhikode), Kerala, India.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days’ notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
